MENTAL CAPACITY ACT 2005
Incorporating an overview of the forthcoming Deprivation of Liberty Safeguards, which are due to come into force on 1st April 2009 – Tina Kukstas
The Mental Capacity Act (2005) provides a statutory framework to empower and protect vulnerable people who are not able to make their own decisions. This one-day workshop is aimed at providing ‘decision making’ staff with an awareness and understanding of their roles and responsibilities within the Act, which was implemented in April 2007. In addition, it will also provide an overview of the Deprivation of Liberty Safeguards, which will come into force on 1st April 2009.
Aims and Objectives:

To gain knowledge of the 5 key principles of the Mental Capacity Act.

To identify areas of the legal framework within the Act (e.g. Court of Protection, Public Guardianship Office, Lasting Power of Attorney and Court Appointed Deputies. The Role of the IMCA).

To know when to assess for capacity, who should assess for capacity and how to assess for capacity using the 2 and 4 stage tests.

To gain an understanding of the Deprivation of Liberty Safeguards and prepare for the practical implications.
